By accessing, browsing, or interacting with our directory services, checklist utilities, and ecosystem waitlists, you explicitly agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, you must immediately stop using the Website.

1. Proprietary Rights and Database Protection

1.1 Ownership of Database

All components, assets, and materials displayed across this platform—including but not limited to the selection, coordination, arrangement, styling logic, religious specialty tagging, directory card metrics, original 2-sentence summaries, and pricing benchmarks—constitute a protected database under the Singapore Copyright Act 2021. This database represents an intellectual creation compiled through a significant investment of time, corporate effort, capital, and specialized research. We reserve all proprietary and intellectual property rights over this compilation.

1.2 Original and Watermarked Visual Assets

Any parlor images, structural layout matrices, brochures, or graphic illustrations hosted across this environment are the exclusive property of Funeral Compass. Visual assets may incorporate semi-transparent, embedded tracking watermarks. Copying or redistribution of these images is strictly prohibited and constitutes clear evidence of data misappropriation.

2. Prohibited Uses & Anti-Scraping Mandates

2.1 Prohibition of Scraping and Automated Access

Users are strictly prohibited from using, or permitting the use of, any automated system, software, script, or “robot” (including spiders, web scrapers, offline readers, or automated extraction tools) to access, query, or extract data from the Website for any reason.

2.2 API Restrictions

Bypassing front-end user displays to extract bulk JSON structures, schema architectures, or content sets via hidden pathways, including the WordPress REST API, is strictly forbidden.

2.3 Rate Limiting and Access Management

To protect mourning families from platform downtime and preserve host stability, we implement strict automated rate-limiting controls.

• Any device, IP address, or network array found requesting page volumes that exceed standard human usage limits (including but not limited to accessing more than 50 directory listings within a 60-second window) will be flagged as an automated bot.
• Our firewalls will automatically block flagged addresses from accessing the ecosystem for a rolling 24-hour period or permanently.

3. Enforcement, Honeypots, and Liquidated Damages

3.1 Use of Honeypot Markers

This Website contains intentionally placed “seed” data points, artificial names, and tracking markers (“Honeypots”) deep within its directory listings. These honeypots serve the sole purpose of identifying unauthorized data scraping and redistribution. The appearance of these unique tracking markers within any third-party digital environment or competing directory will be used as prima facie (clear and sufficient) evidence of data theft and a direct breach of these Terms.

3.2 Liquidated Damages

You acknowledge and agree that unauthorized data extraction, database scraping, or directory reskinning causes immediate, severe, and irreparable financial harm to Funeral Compass.

• In the event of a breach of Section 2 or Section 3 of these Terms, you agree to pay Funeral Compass liquidated damages in the amount of SGD $100.00 for every individual listing or data point extracted or redistributed.
• You explicitly acknowledge that this sum represents a genuine, reasonable pre-estimate of the operational losses, development costs, and market degradation incurred, and is not a penalty.

4. Disclaimers and Limitations of Liability

4.1 Comparative Data Disclaimers

Package pricing structures, service inclusions, and options shown across this directory platform are aggregated for comparative and transparency purposes and are updated periodically. Final transaction metrics, scheduling availability, and actual costs remain subject to change by individual funeral homes or service providers.

4.2 Binding Agreements

Funeral Compass does not directly sell funeral packages. Users are strongly advised to request a fully itemized, legally binding contract directly from their appointed, NEA-licensed Funeral Director prior to completing any financial transactions or service agreements. We are not liable for disputes arising between consumers and third-party vendors listed on our platform.

5. Vendor Terms and Questionnaires

Any funeral professional or vendor registering an account, claiming a listing profile, or completing our platform optimization questionnaires agrees that the aggregated data layouts, evaluation summaries, and trust metrics generated remain the proprietary intellectual property of Funeral Compass. Vendors are granted a limited, revocable license to display our official “Verified” trust badges on their verified business channels, provided they maintain an active, fully authorized listing status on our platform.

6. Governing Law and Jurisdiction

These Terms shall be governed by, construed, and enforced in accordance with the Laws of the Republic of Singapore. Any dispute, claim, or enforcement action arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Courts of the Republic of Singapore.

7. Intellectual Property and Third-Party Content

7.1 Nominative Use of Directory Assets

Funeral Compass compiles public business directory information for comparative community indexing. Brand names, logos, and publicly available imagery displayed on unverified profiles remain the exclusive intellectual property of their respective copyright holders.

7.2 Copyright Take-Down Policy (Notification of Infringement)

We respect the intellectual property rights of others. If you are a licensed funeral professional or content creator and believe that any imagery hosted on our platform has been utilized without proper authorization, please submit a formal Take-Down Request to [email protected]. Your request must include: (a) verification of your ownership rights, (b) the specific URLs containing the disputed material, and (c) your direct contact details. Upon verification, the disputed assets will be removed or updated within forty-eight (48) business hours.

8. Content Submissions by Registered Vendors

8.1 License Grant

By claiming a directory listing profile, uploading corporate media, submitting pricing brochures, or publishing imagery to this platform, the registered vendor explicitly warrants that they possess full legal copyright authority or valid licensing over those digital assets. The vendor hereby grants Funeral Compass a perpetual, non-exclusive, irrevocable, royalty-free, worldwide license to host, cache, store, modify (for formatting purposes), publically display, and distribute these assets across our web directories, mobile applications, and marketing channels.

8.2 Indemnification for Third-Party Claims

The registered vendor agrees to indemnify, defend, and hold harmless Funeral Compass, its directors, and technical administrators from and against any and all claims, liabilities, damages, losses, or expenses (including legal fees on a full indemnity basis) arising out of or in connection with any third-party copyright infringement claims relating to media, imagery, or textual copy uploaded directly by the vendor to the Website.
